Welcome to ParkBooker.com (the “Website”), operated by ParkBooker Pty Ltd ABN 59 887 581 446 (“ParkBooker”, “we”, “our” or “us”). By accessing and using this Website, you agree to be bound by these Terms of Use and our Privacy Policy.

If you do not agree with these terms, you must not use the Website.

We may update these Terms of Use at any time without notice. Your continued use of the Website following any changes will be deemed acceptance of the updated terms.

These Terms govern your general use of the Website. Separate Booking Terms & Conditions apply if you make a reservation through the platform.

You may use the ParkBooker.com website (“the Website”) to browse listings, make legitimate bookings with Parks, submit reviews or feedback based on your experiences, and manage your travel preferences. By using the Website, you agree to comply with all applicable laws and these Terms of Use.

2.1 What You May Do

You are permitted to:

  • Search and browse holiday parks listed on ParkBooker
  • Make genuine, lawful bookings for yourself or others with their consent
  • Leave honest reviews or feedback about stays you have personally experienced
  • Create an account to manage bookings and saved preferences

2.2 What You Must Not Do

You must not:

  • Make false, speculative, or fraudulent bookings
  • Impersonate others or create fake accounts
  • Use bots, scrapers, or automated systems to access or collect data from the Website
  • Upload or transmit any viruses, malware, or other harmful code
  • Interfere with the operation of the Website, including by attempting to bypass security controls
    Post or submit any defamatory, abusive, discriminatory, misleading, or illegal content
  • Harass, abuse, or threaten Parks, other guests, or ParkBooker staff

2.3 Account Responsibility

If you create a user account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately if you suspect unauthorised access or activity.

2.4 Enforcement

ParkBooker may, at its sole discretion and without prior notice, suspend or permanently restrict your access to the Website if you breach these Terms or engage in any activity we deem harmful to the Website, our business, or our community.

3. Intellectual Property

3.1 Ownership of Content

All content on the ParkBooker.com website, including, but not limited to, text, images, graphics, icons, software, code, user interface elements, logos, trade names, and trademarks (collectively, “Content”), is the property of ParkBooker Pty Ltd or licensed to us by third parties or Parks.

The layout, look and feel of the Website are protected by copyright and other intellectual property laws under Australian and international law.

3.2 Use of Website Content

You may view, download, and print individual pages of the Website for your personal, non-commercial use only. Any other use of the Website’s Content, including reproduction, modification, distribution, republication, or commercial exploitation, is strictly prohibited without ParkBooker’s prior written consent.

You must not:

  • Copy, publish, or distribute Park listings or images for use on other platforms
  • Use ParkBooker branding in advertising, promotions, or third-party apps
    Reverse engineer, decompile, or extract source code from the Website

3.3 Trademarks

“ParkBooker” and associated logos are trademarks or registered trademarks of ParkBooker Pty Ltd. All other trademarks appearing on the Website are the property of their respective owners. Use of any trademark without prior consent is strictly prohibited.

3.4 User-Generated Content

If you submit reviews, photos, ratings, or other content to the Website:

  • You grant ParkBooker a non-exclusive, royalty-free, perpetual, and worldwide licence to use, display, modify, reproduce, and distribute that content for any purpose related to our platform, marketing, or services
  • You confirm you have the legal right to submit such content and it does not infringe any third-party rights

3.5 Infringement Claims

If you believe that any content on the Website infringes your intellectual property rights, you may notify us by contacting legal@parkbooker.com or our Support Team. We will investigate and take appropriate action, including removal of infringing material where necessary.

4. Limitation of Liability

4.1 No Guarantee of Availability

While we strive to maintain continuous access to the Website, ParkBooker does not guarantee that the Website will be available at all times or free from errors, interruptions, or delays. Temporary disruptions may occur due to maintenance, system upgrades, or unforeseen technical issues.

ParkBooker reserves the right to suspend or restrict access to any part of the Website at any time without notice.

4.2 Accuracy of Information

Information displayed on the Website, including park availability, descriptions, pricing, images, and policies, is provided and managed by individual Parks. While ParkBooker makes reasonable efforts to ensure accuracy, we do not warrant that all content is current, complete, or error-free.

You acknowledge that Parks are responsible for updating their own listings, and ParkBooker is not liable for any reliance placed on inaccurate or incomplete listing data.

4.3 Limitation of Liability

To the fullest extent permitted by law, ParkBooker:

  • Disclaims all warranties (express or implied) regarding the Website and its content
  • Is not liable for any loss, damage, cost, or expense (including indirect, special, incidental, or consequential loss) incurred as a result of your use of, or inability to use, the Website
  • Is not responsible for the conduct, acts, or omissions of any Park listed on the Website
  • Where liability cannot be excluded by law, ParkBooker’s total liability to you is limited to the greater of: (a) the amount paid by you for the booking related to the claim, or (b) AUD $100.

4.4 Third-Party Websites & Services

The Website may contain links to third-party websites or services (e.g. Google Maps, park websites, affiliate services). ParkBooker does not control and is not responsible for the content, accuracy, or privacy practices of any linked site.

Inclusion of a third-party link does not imply endorsement or approval by ParkBooker. You access such sites at your own risk.

6.2 Jurisdiction

You agree to submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia. This means:

  • You may bring legal action in Victoria, even if you reside elsewhere
  • ParkBooker may also bring action in Victoria or any other appropriate jurisdiction

6.3 International Use

The Website is intended for use by individuals located in Australia. If you access the Website from outside Australia, you do so at your own risk and are responsible for compliance with local laws.

6.4 Dispute Resolution

If a dispute arises, both parties agree to attempt to resolve it informally before initiating any court or tribunal proceedings. Contact our support team first, and we will attempt to resolve the issue within 14 days.

7. Changes to Terms

7.1 Right to Amend

ParkBooker may update or modify these Terms of Use at any time by publishing an updated version on the Website. Changes will take effect immediately unless otherwise stated.

We may provide additional notice (e.g. via email, in-app notifications, or banners) where the changes are material. However, it is your responsibility to review the Terms periodically.

7.2 Continued Use as Acceptance
